Common Causes of Truck Accidents
Arkansas has one of the highest 18-wheeler to passenger vehicle ratios in the country. 18-wheelers account for an estimated 34% of all interstate traffic in Arkansas. But what are the common causes of truck accidents? Let’s take a look:
1. Traffic
Large trucks account for 1 in every 3 vehicles on the interstate in Arkansas. Inevitably, collisions are likely to occur. In some instances, a passenger vehicle fails to give a truck driver the room they need to operate their tractor-trailer safely. In others, a large truck fails to account for a smaller vehicle.
2. Distracted Driving
An estimated 60% to 70% of all truck accidents are caused by distracted driving. Cell phones and navigation are notorious causes of truck accidents in Arkansas. In fact, one study found that nearly 80% of all truck wrecks involved some form of driver inattention in the 3 seconds leading up to the crash.
3. Improper Cargo Loading
Improperly loaded cargo can result in cargo shifting and unbalanced weight distribution. In many cases a third party is responsible for loading the trailer and therefore liable in the case of an accident. You’ll need an experienced truck attorney to help you determine who is ultimately at fault.
4. Driver Fatigue
Driver fatigue accounts for roughly 13% of all truck accidents. Drowsy driving can be the result of inadequate sleep, extended work hours, or strenuous activity.
5. Reckless Driving
22% of trucking accidents result from an 18-wheeler colliding with the rear end of a passenger vehicle. While driver inattention plays a role often speeding (or reckless driving) is involved in the collision. Additionally, passenger vehicles often fail to give semi-trucks the room they need to brake. A fully loaded 18-wheeler can require the length of a football field to come to a complete stop.
6. Equipment Failure
Inadequate inspections, worn tires, or defective parts all play an unfortunate role in trucking accidents. The size and weight of an 18-wheeler puts significant strain on its mechanical components. Like improperly loaded cargo, equipment failure may mean someone else is liable. Talk to a truck accident lawyer if faulty equipment played a role in your collision.
7. Driving Under the Influence
Driving under the influence of drugs or alcohol is always dangerous. That danger is compounded when an 18-wheeler is involved. Alcohol impairs a driver’s ability to make decisions soundly or quickly. Reaction times are delayed and coordination is impaired when drugs and alcohol are involved.
If you’ve been involved in a large truck wreck, then we’d advise you to call a truck accident lawyer near you.
Whether you choose to hire an attorney or not, an experienced truck wreck lawyer will help you explore your options and ensure you’re being treated fairly. They can answer your questions and point you in the right direction.

Where are Truck Accidents Most Likely to Occur in Arkansas?
There are 2 places where a truck accident is likely to occur. One is the interstate. And another is an intersection.
Interstates and freeways are the most likely places a truck accident will occur. Interstates that experience high truck volume in Arkansas include:
- I-40
- I-30
- I-55
- I-49
I-40 in Arkansas is one of the highest-trafficked interstates in America. One-third of the vehicles crossing east to west across Arkansas are large trucks. Trucks transport cargo and goods from one location to another and primarily utilize freeways and interstates.
When they exit the freeway, though, intersections become hot spots for accidents. An 18-wheeler needs significantly more room to maneuver. Watch out for trucks turning left and right at red lights and stop signs!
Common Injuries After a Truck Accident
Because each collision is different, no two injuries are exactly alike. However, there are some injuries that people commonly experience after being in a crash. The most common injuries following a truck accident are:
Whiplash
…is one of the most common injuries resulting from a truck accident, happening most often in rear-end collisions. Whiplash occurs when your head and neck are suddenly jerked back and forth (like the cracking of a whip…hence the name), and symptoms include neck pain, stiffness, and headaches. Most symptoms resolve over time, but they may require medication or therapy. Moreover, a smaller number will suffer from chronic neck problems and pain afterward. Other neck injuries include disc injury and cervical radiculopathy (irritated nerves).
Back Injuries
Your spine is divided into three different sections: cervical, thoracic, and lumbar vertebrae. With the discs, muscles, tendons, and nerves in your spinal area, back injuries are common, but also very painful. In a truck wreck, back injuries can range from strained muscles or dislocated discs to even serious spinal cord trauma. In many cases, chiropractic work or physical therapy can relieve pain and help realign your spine, but some injuries may require surgery to restore mobility. Never ignore back pain after being in a crash.
Concussions
…are usually caused when your head strikes a part of the vehicle, such as the steering wheel or window, giving your brain a “jolt” that can actually cause it to move inside your skull. A concussion is classified as a mild traumatic brain injury. If you or someone you love has been involved in a truck wreck, then we’d advise you to watch for signs of a concussion: confusion, slurred speech, nausea or vomiting, headaches, blurred vision, or memory loss.
Leg and Knee Injuries
Most people think of upper body injuries when discussing wrecks, but your legs and knees are also at risk. These injuries usually result when a passenger hits their knees or legs on the dashboard, or when part of the vehicle is smashed inward. The knee area, with its ligaments and tendons, is especially prone to injury. Other possible injuries include fractures, broken bones, or cuts and bruises.

How Does a Truck Accident Lawyer Gather Evidence?
Trucking accident claims are notoriously complex. Hiring an experienced trucking law firm ensures you’ll be best represented.
Taylor King Law have experts in the field who specialize in truck accidents. From inspections to accident reconstructions.
When a tractor-trailer is involved in an accident, responsibility and liability go beyond the drivers involved to include the owner, whoever is leasing the truck or trailer, the manufacturer of the vehicle, and/or the shipper and loader of the cargo.
We’ll research the company carrier, the trailer’s set-up, and training requirements. We’ll consider Arkansas’ driving requirements in addition to the federal regulations that all truck drivers face.
Frequently Asked Questions for Truck Accident Lawyers
What Types of Compensation Am I Eligible to Receive?
In terms of the types of claims you might open after a truck accident, you have several options.
Property damage to your vehicle is one claim to compensation. Notably, the cost of any and all medical services are recoverable after a truck wreck.
In addition to property damage and medical bills, you also have the right to be compensated for pain and suffering. To best understand what qualifies as pain and suffering, we’d recommend speaking with an attorney.
Other types of compensation that you can seek include mental anguish, lost wages, lost profits, and the injury itself.
Additionally, some injuries are permanent in nature. Future damages can be proven and claimed.
An experienced law firm can make sure you receive full compensation and that nothing is missed. To get full compensation after a trucking accident, you’ll need a law firm that knows the ins and outs of truck wreck claims, and that is attentive and able to listen to all of your concerns.
We’re often asked how much compensation is available. Every case is unique, but once your attorney has to opportunity to review your accident and injuries, they can begin to help you set expectations for how much your case is worth. To find out how much compensation you’re eligible to receive, call Taylor King today for a free consultation.
What Is the Statute of Limitations in Arkansas?
A truck wreck claim falls under the umbrella of a personal injury claim.
In Arkansas, you have 3 years from the date of your accident to file a personal injury lawsuit. This window that you have to file a lawsuit is what’s known as the statute of limitations. Personal injury claims include truck accidents.
The statute of limitations can vary from state to state, which is why it’s critical to hire a local car accident lawyer in Arkansas.
When you call to speak with an attorney, one of the initial questions you’ll be asked is when the accident took place. With this information, a law firm will be able to obtain a police report as well as ensure your case meets the necessary statute of limitations.
Will My Case Go to Litigation?
Typically, personal injury claims are settled outside of court without having to file a lawsuit. Attorneys can help you position your claim to settle outside of court while preparing to go to court if necessary. Trucking companies have big legal teams and may force your case to go to court. If that’s the case, Taylor King Law is prepared to take on the biggest team and handle your claim from start to finish.
Your attorney will discuss the various types of compensation you’ll be able to seek. They’ll ask questions, and make sure that you receive full compensation for your damages.
What is Modified Comparative Fault?
The modified comparative fault rule applies in the state of Arkansas. When more than one party is involved in an accident, a percentage of fault is applied to each party. To file a lawsuit, the plaintiff’s fault cannot exceed 49%.
Oftentimes, an insurance company will claim that the victim was partially at fault for the accident. Modified comparative fault states that the plaintiff cannot seek damages if they are found to be 50% or more at fault.
Your attorney will be responsible for handling this part of your truck wreck claim and ensuring you receive compensation.
How Much Is My Truck Accident Claim Worth?
There’s no sure-fire system for evaluating the exact amount of what your case is worth. However, our team of attorneys has more than 275 years of combined legal experience. We understand the process and know how to maximize your case. And we’ll be honest and upfront about what we can do for you.
If you have questions about compensation or how much your claim might be worth, your best bet is to call an Arkansas truck accident attorney. With enough information, we can help you better understand the value of your claim.
What Difficulties Will I Face with Insurance?
There are 2 common tactics that an insurance adjuster will use to try and settle your claim at a lower value:
- They’ll try and settle your claim immediately, or…
- They’ll delay settling your claim as long as possible.
First, it’s important to know that both tactics are very common. Many insurance companies use these tactics! Be on the lookout if you’re handling your claim on your own.
