Lawsuits Against 3M Earplugs

What’s the latest news regarding 3M earplugs? In August of 2023, 3M agreed to pay $6 billion in an effort to resolve 300,000 lawsuits against the manufacturer. The lawsuits allege that 3M supplied military personnel with faulty combat earplugs that led to significant injuries.

In a release, 3M said, “the agreement is not an admission of liability.”

What are 3M earplugs?

3M Combat Arms Earplugs (CAEv2) are earplugs designed for military personnel and feature a two-sided design. The two-sided design was meant to block out all sound when in the “closed position” and to block out loud sounds, but allow softer sounds in the “open position.” Softer sounds include speech and nearby movements.

The two-sided design would potentially allow soldiers to distinguish speech and commands, but block out harmful and loud sounds.

3M’s Combat Arms Earplugs were standard issue for more than a decade.

How are 3M earplugs defective?

According to the government, the 3M earplugs were “too short for proper insertion in users’ ears,” and failed to form a proper seal in the user’s ear canal. The defect meant the earplugs would loosen in the ear, allowing harmful sounds to unknowingly lead to potential hearing loss and auditory damage.

As early as 2000, 3M had become aware of the defects in their earplugs. Auditory tests revealed the defect, rendering the earplugs less effective than communicated. Yet, 3M failed to reveal to the military that the defect existed.

3M intentionally misled the military. Their failure and negligence, according to lawsuits, “has likely caused thousands of soldiers to suffer significant hearing loss and tinnitus.”
